Auction Terms and Conditions

Welcome to the MadameFlihanLDA Auction Platform. By participating in our auctions, you agree to abide by the following terms and conditions. Please read them carefully to ensure a smooth and enjoyable auction experience.

1. Auction Process

  • Registration and Verification: All participants must register in advance and comply with identity verification requirements in accordance with legal standards. This includes strict adherence to anti-money laundering (AML) regulations to ensure a secure and transparent auction process.
  • Bidding:
    • Bids can be placed online during the auction period.
    • All bids are legally binding and cannot be retracted once submitted.
    • Reserve prices may be applied to some items. If the bidding does not reach the reserve price, the item may remain unsold.
    • A minimum deposit of 10% of the starting price is required to participate in the auction. In the event that no bids are placed or no transaction occurs, the deposit will be refunded within a maximum of 5 working days.
  • Winning Bid:
    • The highest bid at the close of the auction will be declared the winning bid.
    • In the case of a tie, the earliest bid will be considered the winner.
    • Winning bids are final upon acceptance, establishing a firm commitment to the sale.
    • Regulation on Deposits: All participants must pay a deposit of 10% of the starting price to be eligible to place bids in the auction. This deposit is refundable in case no bids are placed or no transaction is completed, within 5 working days. Once the auction ends and a winning bid is confirmed, the deposit will be applied to the total purchase amount.

2. Payment Terms

  • Payment Method: Winning bidders must complete payment within [5] days of the auction closing date. Accepted payment methods include credit/debit cards, bank transfers, PayPal, and MB WAY.
  • Sales Tax: Applicable sales tax, including IVA (for Portuguese clients), will be added to the final bid price as required by law.
  • Failure to Pay: If payment is not received within the specified timeframe, MadameFlihan LDA reserves the right to cancel the sale and re-offer the item.

3. Item Description and Condition

Auction Transparency: The gallery guarantees full transparency, providing detailed information about each artwork, including its provenance, condition reports, and other relevant details to enable informed decision-making.
“As Is” Policy: All items are sold “as is.” Descriptions are prepared to the best of our knowledge, and we encourage bidders to inspect items and ask questions prior to bidding.

4. Shipping and Handling

  • Shipping Responsibility: Buyers are responsible for all shipping arrangements, costs, and insurance for items won at auction. These responsibilities ensure the safe and secure delivery of purchased artworks.
  • Pickup Option: Local pickup may be available for certain items. Details will be provided in the auction listing.

5. Returns and Refunds

  • All Sales Are Final: No returns or exchanges will be accepted unless the item is significantly misrepresented in the auction description.
  • Refunds: Refunds are issued only in cases of substantial misrepresentation and are subject to the discretion of MadameFlihan management.

6. Compliance and Liability

Anti-Money Laundering Compliance: The gallery enforces full compliance with AML regulations for both offline and online auctions. Bidder identities are verified, and the source of funds is thoroughly checked to meet legal standards.
Liability: While every effort is made to ensure accurate auction listings, MadameFlihan LDA is not responsible for errors or omissions. Participation in the auction is at the bidder’s own risk, and the gallery is not liable for any losses or damages incurred.

7. Changes to Terms

MadameFlihan LDA reserves the right to modify these terms and conditions at any time. Continued participation in our auctions constitutes acceptance of any changes made.
