3. Purchases and Payment Terms

  • Accepted Payment Methods: We accept major credit cards, bank transfers, and other specified payment options.
  • Payment Processing: All payments are securely processed. For online transactions, additional fees for processing or currency conversion may apply.
  • Auction Payments: Winning bidders are required to make payment within 5 working days of the auction’s conclusion. Failure to pay within this period may result in forfeiture of the winning bid.
  • On-Site Purchases: Purchases made directly at our gallery are subject to offline sales Law in Portugal.

5. Shipping, Delivery, and Collection

  • Shipping: We ship locally within Portugal and internationally. Shipping fees, insurance, and applicable taxes will be calculated at checkout.
  • Delivery Timeline: We aim to dispatch items within 5 business days of confirmed payment. Shipping times vary based on the destination.
  • On-Site Collection: Artworks purchased on-site can be collected at the gallery. Please bring proof of purchase and identification at the time of collection.
  • Damaged or Lost Items: In the event of any damage during shipping, please notify us within 48 hours of receiving the item for assistance.
  • Domestic Delivery: Shipments within Portugal typically take 5-7 business days to arrive after dispatch.
  • International Delivery: International orders usually arrive within 10-15 business days, though times may vary depending on customs clearance.
  • Damages During Transit: Notify us within 48 hours of receiving a damaged item, including photos and descriptions. Retain original packaging for returns.
  • Lost Shipments: If your shipment does not arrive within the estimated time, contact us for assistance.
  • Resolution Process: For damaged items, we will arrange returns and provide a replacement or refund if necessary

6. Returns and Refunds

  • General Policy: All sales of artwork are final, except in cases where artwork is damaged upon arrival.
  • Return Conditions for Online Purchases: Refunds may be granted if artwork arrives in damaged condition. Please notify us within 48 hours of receipt to qualify for a return.
  • Auctioned Items: All auction sales are final and non-refundable.
  • Note to Client: Please confirm if there are additional return policies for art consultancy or event-related services.

7. Auction Terms

  • Fully online international art auctions managed in Spain via madameflihan.com.
  • Preview exhibitions at Lagoa-Carvoeiro for clients to view works before bidding.
  • Live-streamed auction viewing with staff support for registrations and bidding assistance.
  • Private sale services, all under Spanish commercial law.
  • Eligibility: Participants in our auctions must be at least 18 years of age and have a valid form of identification.
  • Bidding: All bids placed are legally binding, and winning bids constitute an agreement to purchase.
  • Winning Bids: The highest bid at the close of the auction wins, provided the bidder complies with all payment terms.
  • Reserve Prices: Some auction items may have a minimum reserve price. If this reserve is not met, the item will not be sold.
  • Regulation on Deposits: All participants must pay a deposit of 10% of the starting price to be eligible to place bids in the auction. This deposit is refundable in case no bids are placed or no transaction is completed, within 5 working days. Once the auction ends and a winning bid is confirmed, the deposit will be applied to the total purchase amount.

8. Events and Reservations

  • Event Registration: Attendance at gallery events may require pre-registration. We reserve the right to limit or deny entry based on availability.
  • Cancellations: If you must cancel a reservation, please contact us at least 48 hours in advance. Refunds for paid events will be granted based on our refund policy.
  • VIP Events: Access to VIP events is limited to members of our Preferred Members Club and special invitees.

9. Consultancy Services

  • Scope of Service: Our art consultancy services include personal and corporate art selection, interior design integration, and investment advice.
  • Fees and Payments: Consultancy fees are billed as per our agreement and may require a deposit before service initiation.
  • Liability: MadameFlihan is not liable for financial outcomes of art investments or personal use of consultancy advice.
  • Specific terms around payment structures for consultancy services or client liability disclaimers will be regulated and clarified in a contract.

10. Limitation of Liability

  • MadameFlihan is not liable for any indirect, incidental, or consequential damages arising from the use of our website, products, or services.
  • All products and services are provided “as is” without any warranty of merchantability or fitness for a particular purpose.

  • We reserve the right to modify these Terms at any time. Any changes will be posted on this page, with the date of the latest revision indicated at the bottom.
